The Land Use Law Center is pleased to announce the 22nd annual Alfred B. DelBello Land Use and Sustainable Development Conference. Scheduled for December 7 - 8, 2023, this year’s conference theme is Balancing Economic Realities with Environmental and Social Concerns.

As in previous years, the Land Use Law Center has been working on developing a conference program that will showcase innovative best practices in land use and sustainable development.

Additional highlights of the conference include:

  • On Thursday, December 7th, the Center will be hosting  the Founders Award Dinner.

  • Featured sessions on comprehensive and environmental plans and tools, affordable green housing, takings law and case updates, ethics in law and planning, resiliency and energy and so much more.

Day One Agenda:

9:00 – 10:00    Welcome and Introductions. Tiffany Zezula, Deputy Director, Land Use Law Center and Staff Consultant, Housing Action Council. This session will provide an introduction to the program and introduce trainers and participants.

10:00 – 11:30 The Land Use System and What’s in Your Comprehensive Plan? (1.5 CLE Practice) Jessica Bacher, Executive Director, Land Use Law Center and Staff Consultant, Housing Action Council; Tiffany Zezula, Deputy Director, Land Use Law Center and Staff Consultant, Housing Action Council. This session will review the basic operation of the land use system and comprehensive planning as a basis for understanding how affordable housing can be encouraged.

11:30 – 11:45 Break

11:45 – 12:15 Site Constraints (.5 CLE credits) Tiffany Zezula, Land Use Law Center; John Fry, AIA, Principal, Nexus Creative Design; Jaclyn Tyler, AIA, Principal, Nexus Creative Design. Trainers will provide an overview of site considerations as a preface for the site drawing session. Each team will be provided a map of their site and discuss site constraints, zoning challenges, zoning opportunities, and housing considerations.

12:15 – 1:00 Lunch

1:00 – 2:15 Site Drawings - John Fry, AIA, Principal, Nexus Creative Design; Jaclyn Tyler, AIA, Principal, Nexus Creative Design; Rob Lane, Plan & Process; David Kim, David Kim Architects; Jason Mencher, AKRF; Michael Patino; Peter Feroe, AKRF. Participants will work with our team of architects to sketch site designs for their proposed sites.

2:15 – 2:45 Presentation by Municipal Teams on their Designs Participants will go to each municipal table to hear about their proposed designs

2:45 – 3:00 Preparing for Day Two

9:00 – 9:15 Review of the Day

9:15 – 9:45 Zoning Considerations (.5 CLE) Tiffany Zezula, Land Use Law Center; Peter Feroe, Vice President, Planning and Land Development, AKRF. Presentation will be given highlighting the various zoning tools to create affordable housing.

9:45 – 11:15 Financing and Funding Affordable Housing (1.5 CLE) Doug Olcott, Senior Vice President, Regional Director, Hudson Valley Office, The Community Preservation Corporation; Matt Spallina, Loan Officer, The Community Preservation Corporation; Danny Wheelan, Loan Officer, The Community Preservation Corporation; Rose Noonan, Executive Director, Housing Action Council. This session will review the financing of affordable housing, including the various Federal and State programs available for funding. A sample pro-forma will be reviewed, including project feasibility, land disposition, construction costs, and legal implications.

11:30 – 12:30 Facilitated Table Discussions Each group will have a facilitator lead them in discussion regarding the zoning regulations for their site and finance considerations.

Founder’s Award Dinner will be held on Wednesday, December 7, 2022.  Join us for a pre-conference reception and networking event at at Haub Law School at Pace University, Tudor Room, 78 North Broadway, White Plain, NY, as we honor this year’s Founder’s Award Recipient, John R. Nolon.

Twenty years ago, land use was well grounded. Local leaders were able to make steady progress to further environmental protection, sustainable development and the revitalization of cities and urban villages. Through optimistic guides to problem solving, using innovative land use laws, Professor John Nolon championed these efforts. Since then, localities have been challenged to address fair housing, a pandemic, shocking revelations of our racist history, threats of preemption of local power, and the ravages of climate change. The challenges today are much greater than in 2001 when Well Grounded: Using Local Land Use Authority to Achieve Smart Growth was first published. A new approach to properly using local land use power is needed. The conference is dedicated to furthering this exploration and to the prolific body of work of Professor John Nolon.

The viral pandemic has challenged the land use system to create safe sites and buildings to protect the public health and stabilize neighborhoods. This pandemic is exacerbated by three other dynamic forces that equally threaten public health: climate change, housing insecurity, and racial discrimination. The conference will explore how to meet the growing challenge of these four “pandemics” through land use policy and regulation innovation.
